CONDITIONS OF HIRE
Bayline Group Limited (the company) appreciated the opportunity of submitting its quotation for hire together with its standard terms and conditions of hire which ensures that you the hirer are protected and the best interests of both parties catered for.
The rate charged is appropriate to coach star grading/capacity. Requested variation in coach grading/capacity and rate from that originally applied is dependent on availability and subject to application prior to departure date.
The rates quoted are net rates in New Zealand currency and exclude GST unless otherwise stated. Payment in full is required prior to tour departure unless approval has been granted by (the company) for credit terms to apply. In such event, settlement in full must be made by the 20th of the month following debit of the charge.
As a very keen price has been quoted timeous settlement is imperative. Should the account rendered not be settled on due date, interest at the rate of 2.5% per month or part thereof shall be charged from the date of hire. Any costs incurred by the (the company) in collection of such arrears shall be for the hirers account.
The company issues this quotation in good faith and in accepting this quotation, the hirer hereby binds him/herself as surety and co-guarantor for the due and proper settlement of the account. In the event of a dispute, the hirer shall settle the amount claimed in full and then make representation to the company in respect of the said dispute. In the event of a credit being warranted, the company undertakes to refund the hirer such amount within seven days of the resolution of the dispute.
Should the distance travelled and/or duration of hire exceed that anticipated in this quotation resulting in increased costs, the company reserves the right to adjust these rates accordingly.
In the event of there being cost increases in relation to fuel, driver contract rates and/or other costs by legislation between the date of this quotation and the date of hire, the company reserves the right to adjust this quotation to take such increased costs into account. In fairness the hirer has the opportunity of accepting the new price or cancelling the hire.
The quoted rates include the services of a Courier/Coach Driver unless stated otherwise.
The company will ensure every reasonable effort is made to carry out the hirer’s requirements and no responsibility is accepted for additional costs caused by delays occasioned by changes in roading conditions or deviations from normal routes, floods or other unusual circumstances, industrial action, sickness of staff or passengers. The company reserves the right to substitute alternative equipment at its option in the event of unanticipated circumstances which necessitate a change.

DRIVERS EMPLOYMENT CONTRACT REQUIREMENTS
The hirer will be responsible for arranging and meeting the cost of the Coach Drivers meals and overnight accommodation, such accommodation where available at the destination must be of the same standard as the majority of the tour party and at all times should be of a standard not less than a single bedroom with a wash hand basin. Where accommodation provided for the Coach Driver is not up to this standard and the Coach Driver has been unable to secure alternative accommodation within 2 kilometres up to this standard and additional charge shall be payable for each night as prescribed in our company Driver Employment Contract. Camping, Marae/Farm stay tours incur a similar additional charge. Rates are available on application.
